The present General Terms and Conditions are applicable to all the orders on the website http://www.koukaparis.com
1. ORDERS AND CUSTOMER ENGAGEMENT
By validating his order, the Customer acknowledges having read the present General Terms and Conditions and expressly declares to accept them unreservedly. The General Terms and Conditions are governed by French law and may be modified at any moment without prior warning. As a consequence, the Customer is fully aware of the fact that his agreement on the content of present general terms does not require a handwritten signature of this document, to the extent that the Customer wishes to order online presented products.
At the time of his first order, the Customer must open an account and complete an order form with certain obligatory fields so that his order could be taken into account. The Customer has to provide full and correct information. An identification code and a password allowing access to a website are confidential and should not be disclosed to third parties. After clicking on the button "Register", the Customer receives a registration confirmation by email.
In accordance with the provisions of article 1369-2 of the Civil Code, the Customer has a possibility,before the final validation of his order, to verify the details and the total amount, to correct possible actual errors, before validating the order and thereby expressing his acceptance. After the validation of the order, the Customer shall receive the order confirmation email sent by the SJB company. Thus the order is considered final. According to the provisions of article L.122. 1 of the Code of Consumption, the SJB company has the right to cancel or refuse any order placed in error or bad faith or any order from a Customer with whom there would be a litigation relating to the payment of a former order.
2. PRICE OF ITEMS
The prices of our products are indicated in EURO including French value added tax but excluding delivery charges. All orders placed on our website are payable in EURO. The prices are valid for the current month. The products will be invoiced at the price in force at the time the order is received, subject to availability on that date.
Title retention clause: the products remain the property of the SJB company until full receipt of payment by the SJB company. According to the provisions of article L.121 19 of the Code of Consumption, the Customer shall receive, upon delivery of his order, a detailed written confirmation of prices paid for the items and the delivery costs at his charge.
3. METHODS OF PAYMENT
We accept payment by credit card or by Paypal. The cards authorized for payment are "CB" network payment cards, Visa, Eurocard/Mastercard, in metropolitan France (including Corsica and DOM TOM), Monaco and Belgium. When ordering via the Internet, the Customer provides in a secure environment his bank details (the sixteen digit number and the expiry date displayed on the front of his bank card, as well as the numbers of visual cryptogram appearing on the back of his bank card).
4. DELIVERY COSTS
We process and dispatch the orders on working days, Monday to Friday, except holidays.
Your parcel will be processed and sent to you within 5 working days.
Delivery in France
The SJB company suggests the following delivery methods:
- Colissimo Point relais : delivery within 3/5 days after order dispatch, for an amount of 5,90€ and free from 50€ of purchase.
In the case the package is not picked up within 15 days at the pickup point, the return costs will be borne by the customer.
- Colissimo without signature: delivery within 3 to 5 working days after order dispatch, for an amount of 7,90€ in Colissimo without signature and free for a look order or if the amount of the order exceeds 100€
- Colissimo with signature: delivery within 3 to 5 working days after order dispatch, for an amount of 8,90€ in Colissimo with signature
The fact of delivery itself can not be contested if the parcel appears to have been delivered, the haulier register is authoritative.

The products ordered shall be sent to the address indicated by the Customer during the ordering process. For the Colissimo deliveries, if the recipient is absent at the moment when our transport service provider passes, the parcel shall be placed to the post office close to the delivery address. The SJB company may not be held responsible for delays resulting from postal strikes or other unforeseen events as defined in legislation on the transport of property and goods. The SJB company is not responsible for delivery delays caused by incorrect or incomplete address. If the Customer indicates by mistake a delivery address outside of the countries covered by the SJB company, the order will not be honored and the reimbursement will be made by deducting the bank processing fees from the amount of the order. Items shall be delivered after the payment of the total amount of the order has been made. The Customer must ensure that the items delivered correspond to his order. In the event that the delivered items do not comply with the order, he will have to inform the customer service of the SJB company and return the items in question, return costs being borne by the SJB company. In case of an error from our company, the Customer has 14 days after the reception of the order for returning non-conforming item(s) to us. (see paragraph 6- EXCHANGE, RETURN AND REIMBURSEMENT / RIGHT OF RETRACTION)
5. ORDER PROCESSING
The SJB company undertakes to honour orders within 24H of receiving your order only within the limit of available product stock under the condition that we have validated the payment. All orders places imply acceptance of price and description of the products available for purchase. An invoice is attached to the parcel with all information relevant to the order indicated on it.
In the event that one or a few ordered items are not available, the SJB company undertakes to inform the Customer in the shortest possible time and to dispatch him this item as soon as the supplier provides it. If necessary, the order of the Customer will be canceled. The Customer will be refunded not later than within 15 days after the payment of the sums paid for his order.
6. EXCHANGE, RETURN AND REIMBURSEMENT / RIGHT OF RETRACTION
Within the framework of right of retraction as provided for in article L. 121-1 of the Code of consumption, the Customer has a legal deadline of 14 clear days to exercise his right of retraction from the date of receipt of the goods without having to justify any reasons or to pay penalties. The modalities for exercising this right of retraction are mentioned in paragraph "Exchange and return conditions" below.

For any return you need to make a request to KOUKA customer service:

STEP 3: After confirmation from the customer service, you can proceed to return of the items.
The Customer shall return the goods along with the RETURN VOUCHER to the following address, within 14 days from the date when he exercises his right of retraction:

The items discounted or present in the Outlet category can be neither returned, nor exchanged.
The return costs are the responsibility of the customer and we recommend you to return it in a tracked parcel (Colissimo,tracked letter...).
If you wish to make an exchange, you have to return the article(s) in question and place a new order on our website.
The product(s) should be returned in perfect condition and in their original packaging, new, unworn and not washed (original packaging,...).
After receiving the parcel, the SJB company shall evaluate the condition of the returned goods. If the return is refused by the SJB company, the items will be returned to the Customer at the expense of the SJB company without requiring the Customer to any compensation or reimbursement right.
- Return of a defective or non-compliant item at your request
In the event of a fault occurring at the moment of the order preparation, the return costs are the responsibility of the SJB company. A return label will be transmitted to the Customer so that he could return the items concerned with this unfortunate error, free of charge.
- Return of a damaged parcel
In case of receipt of a parcel damaged during its transportation, the Customer is recommended to open the parcel in the presence of the deliverer to check the condition of the items. In the case of damage of the items, the Customer must refuse to accept the parcel. The last one shall be returned to SJB. The Customer will be then contacted again by the seller by email or by phone. If the Customer accepts a damaged parcel, it is imperative to make reservations with the deliverer: the identified damages and/or possibly missing items must be indicated on the tracking voucher with the Customer's signature. Without reservations, SJB will not be able to take into account any possible claims in the future.
• Reimbursement of return
After receiving of your return, we will proceed to the online reimbursement of the returned product(s). The maximum time-limit for reimbursement is 15 days after the receipt of the parcel on our premises.
The reimbursement method is the one used when executing the payment of your order. It will not be possible to change the method of payment for the reimbursement of the order.
7. PRODUCTS' INFORMATION
The pictures illustrating the products are not part of the contract. The indicated dimensions are approximate and may vary. The SJB company may under no circumstances be held liable if errors occur, if the colour or packaging vary slightly.
• Product availability
The products offered by the SJB company are available in our warehouse. If the Customer places an order of a non-stock item and he changes his mind, he shall then have the choice either of requesting a reimbursement of the paid sums within 14 days after their payment, or of product exchange.

10. LAW ON INFORMATION TECHNOLOGIES AND FREEDOM
Providing personal information while placing an order is compulsory because it is necessary for processing and dispatching online orders as well as invoicing. Lack of information leads to the non-validation of the order. According to the law on information technologies and freedom of January 6th, 1978, you have the right to access, rectify and oppose personal information concerning you. 12. THE APPLICABLE LAW AND THE POWERS
This contract is subject to French law. The SJB company may not be considered responsible for the damages of all kinds, so material as immaterial, or physical injuries which could result from a faulty operation or improper use of the products for sale. This applies also to possible modifications of products, coming from a manufacturer. The responsibility of the SJB company, in any case, shall be limited to the amount of the order and shall not be assumed for simple errors or omissions that may have subsisted despite all the precautions it has taken in presenting its products. Any settlement of dispute may be made from our customer service via the email address firstname.lastname@example.org and if no amicable agreement is reached, it shall be referred to the French court.
